PRIVACY POLICY
Introduction:
HEPLO, is a software application developed and owned by Codique LLP and its affiliated entities (hereinafter referred to as “Codique”), and respecting your privacy, which is encapsulated into our Veins. We are committed to taking into consideration your online privacy and acknowledge the need for appropriate protection and management of any personally identifiable information or data shared with us. This Privacy Policy/ies (“Policy”) describes how Codique collects, uses, discloses and transfers personal information of users through its websites and applications, including through its website, mobile application and online services by the name HEPLO (collectively, the “Platform”). This policy helps explain our data practices, including the information we process to provide our Services and applies to those who visit the Platform, or whose information Codique otherwise receives in connection with its services (such as contact information of individuals associated with Codique, including partners). For the purposes of the Privacy Policy, you/your/user/customer shall mean the person who is accessing the Platform.
Personal information (PI) - means any information relating to an identified or identifiable natural person including common identifiers such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person and any other information that is so categorized by applicable laws. We collect information about you and/or your usage to provide better services and offerings. The Personal Information that we collect, and how we collect it, depends upon how you interact with us.
1. DATA WE COLLECT
1.1.
Codique must receive or collect some information to operate, provide,
improve, understand, customize, support, and market our Services,
including when you install, access, or use our Services (below
mentioned keyword – “Services” shall refer to the “Scope of Work” as provided under the Terms and Conditions). We collect the
following categories of Personal Information in the following ways:
1.1.1. name, email address, password, age, country, state, city and contact number when you sign up for account creation and alerts on the Platform;
1.1.2. to ensure you are above 18 years and check that you’re who you say you are, we would require a copy of government-issued ID and also a selfie verification (which involves the collection of real-time face geometry data).
Note: This data is used for verification only and is not visible to other users.
1.1.3. If you give us permission, we collect your geolocation (latitude and longitude) from your device. If you decline permission, features that rely on precise geolocation will not be available to you.
1.1.4. we may collect your Personal Information, such as name, age, contact details, preferences, etc., through surveys and forms, when you choose to participate in these surveys, etc.;
1.1.5. we may also collect information relating to your caste and information about whether you are eligible for any affirmative action programmes or policies, if you opt to provide such information.
1.1.6. when you communicate with Codique or use the Platform to communicate with other Users (such as partners), we collect information about your communication and any information you choose to provide.
1.1.7. when you visit the Platform, we use cookies to automatically collect, store and use technical information about your system and interaction with our Platform and the services used after accessing the Platform;
1.1.8. If you choose to access services offered by any of our affiliates we will share your data with the affiliate in accordance with this policy. When you access the webpage/link or services of our affiliates through the Platform, you will also be governed by the terms and privacy policy of such affiliates. You are advised to read the terms and privacy policy of the affiliates to understand the manner in which the affiliates handle and process your personal data, including sharing your data with Codique.
1.1.9. when you use a device to access the Platform, CODIQUE may collect technical or other related information from the device as well as the device location;
1.1.10. To the extent permitted by law, CODIQUE may record and monitor your communications with us to ensure compliance with our legal and regulatory obligations and our internal policies. This may include the recording of telephone conversations;
1.1.11. If you choose to sign in with your social media account to access the Platform, or otherwise connect your social media account with the services of the Platform, you consent to our collection, storage, and use, in accordance with this Privacy Policy, of the information that you make available to us through the social media interface. Please see your social media provider's privacy policy and help centre for more information about how they share information when you choose to connect your account.
1.2. We may need information about the services that you might be requiring which needs to be displayed and uploaded on the work requirement area of the Heplo’s and for that wemay also require the photos of the work which needs to required or on which it needs to be required, and budget you would be paying to for the execution of the work;
1.3. We do not normally keep copies of your messages as part of providing our Services. Messages are primarily stored on your device and are not generally retained on our servers. After a message has been successfully delivered, it is removed from our systems. However, there are limited situations in which we may temporarily store messages to enable delivery, as described below:
1.3.1. Undelivered Messages. If a message cannot be delivered right away (such as when the recipient is not connected), it is held on our servers in encrypted form for a maximum of 30 days while delivery is attempted. Messages that remain undelivered after this period are automatically deleted.
1.3.2. Media Forwarding. When media content is forwarded, we may temporarily store that content in encrypted form on our servers to facilitate efficient delivery of subsequent forwards.
2. USAGE OF YOUR INFORMATION (THE "NEED TO KNOW" BASIS)
2.1. We use information we have (in accordance with the choices that you tick and law of the land) to operate, provide, improve, understand, customize, support, facilitate, and market our Services.
2.1.1. We use information we have to operate and provide our Services, including providing customer support; completing purchases or transactions; improving, fixing, and customizing our Services; and connecting our Services that you may use. Further, we may also use it to evaluate and improve our Services; research. Develop and test new services and features and conduct trouble shooting activities. We also use your information to respond to you when you contact us. Public Visibility: Your name, rating, and task description are visible to all users.
2.1.2. Once a Task Poster and Helper agree to work together, we may share your phone number or precise location to facilitate the meeting.
2.2. Codique does not disclose, transfer or share your Personal Information with others except with:
2.2.1. Our affiliates and group companies to the extent required for our internal business and/or administrative purposes and/or general corporate operations and for the provision of services aimed at helping you in your career enhancement;
2.2.2. Potential recruiters, if we determine that your resume matches a particular job description/ vacancy available with such recruiters. By registering on the Platform and consenting to the terms of this Privacy Policy, you agree that Codique may contact you or forward your resume to potential recruiters;
2.2.3. If in case you initiate a contact with a specific jobseeker, your contact details may be shared with the jobseeker.
2.2.4. Educational institutions, University or Affiliating University / University which will award your degree, government educational department, training institutes or educational service providers, contest organizers or career session partners for the purpose of career development
2.2.5. Third parties including enforcement, regulatory and judicial authorities, if we determine that disclosure of your Personal Information is required to a) respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims; or b) investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Codique’s Terms of Use or as otherwise required by law;
2.2.6. In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of Codique’s business assets we may disclose Personal Information to those involved in the negotiation or transfer.
2.2.7. Third-party service providers and marketing partners that CODIQUE engages to a) provide services over the Platform on CODIQUE’s behalf; b) maintain the Platform and mailing lists; or c) communicate with you on CODIQUE’s behalf about offers relating to its products and/or services. CODIQUE will take reasonable steps to ensure that these third-party service providers are obligated to protect your Personal Information and are also subject to appropriate confidentiality/non-disclosure obligations.
2.2.8. Third-party advertisers to display advertisements to you when you visit the Platform. The third-party advertisers include financial service providers (such as banks, insurance agents, stock brokers and mortgage lenders) and non-financial companies (such as stores, airlines, and software companies). These companies may use information about you and your visits to this Platform and other websites to provide advertisements on this Platform.
2.3. The Company does not provide any Personal Information to the advertiser when you interact with or view a targeted advertisement. However, if you interact with or view an advertisement, the advertiser may make certain assumptions and, in the process, learn certain Personal Information about you. For instance, if you view and click on an advertisement that is targeted towards women in the age group 18- 24 from a specific geographic area, the advertiser may assume that you meet the relevant criteria.
2.4. CODIQUE does not intend to transfer Personal Information without your consent to third parties who are not bound to act on CODIQUE's behalf unless such transfer is legally required.
2.5. If your Personal Information is transferred outside India, we take the necessary steps to protect your Personal Information in accordance with applicable data protection laws.
2.6. HEPLO’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
3. THE "OFF-PLATFORM" DATA DISCLAIMER
3.1. Heplo does not have control over, and is not responsible for, how another user uses any information you choose to share with them. Once you voluntarily disclose information to another user—whether through the App or outside of it—such information is no longer under Heplo’s control.
3.2. This includes, but is not limited to, the sharing of personal details such as your home or work address, telephone number, email address, social media profiles, or any other identifying or contact information. Heplo bears no responsibility or liability for any use, misuse, distribution, or further disclosure of such information by the receiving party.
3.3. For your safety and protection, Heplo strongly encourages all users to keep their communications and interactions within the App until they decide to meet in person. Communicating through the App allows Heplo to provide platform-based safeguards and support, which may not be available once interactions occur outside the App.
4. DATA SECURITY
4.1. We employ industry-standard encryption and reasonable technical safeguards to help protect your data from unauthorized access, loss, or misuse. Despite these measures, no system or method of data transmission over the internet can be guaranteed to be completely secure. Accordingly, we cannot warrant the absolute security of your information.
4.2. By accessing or using Heplo, you acknowledge and accept the inherent risks associated with transmitting information electronically and agree that Heplo is not responsible for any unauthorized access that occurs despite our reasonable security practices.
5. COOKIES AND TRACKING
5.1. We use cookies and similar tracking technologies to collect information about how users interact with the App, to remember user preferences, and to support essential functionality such as keeping you logged in. These technologies help us analyse usage patterns, improve performance, and enhance the overall HEPLO user experience.
5.2. A "cookie" is a small text file that may be used, for example, to collect information about website activity. Some cookies and other technologies may serve to recall Personal Information previously indicated by a user. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them.
5.3. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you will need to re-enter your original user ID and password to gain access to certain parts of the Platform.
5.4. You may be able to manage or disable cookies through your device or browser settings; however, doing so may limit certain features or functionality of the App.
5.5. Tracking technologies may record information such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; clickstream patterns; and dates and times that our site is accessed. Our use of cookies and other tracking technologies allows us to improve our Platform and the overall website experience. We may also analyse information that does not contain Personal Information for trends and statistics.
6. THIRD-PARTY LINKS
6.1. The App may contain links to third-party websites (like payment gateways or maps). We are not responsible for the privacy practices of those external sites.
6.2. To the extent that your data is retained by CODIQUE, this Policy continues to apply; however, CODIQUE makes no representations or warranties regarding how your information is stored or used on third-party servers. We recommend that you review the applicable privacy statements and policies of each third-party site linked from the Platform to determine their use of your personal information.
7. CHILDREN’S PRIVACY
7.1. To use the Platform, you agree that you must be the minimum age (described in this paragraph below) or older.
7.2. The minimum age for these purposes shall be eighteen (18). If local laws require that you must be older for CODIQUE to be able to lawfully provide the services over the Platform to you, then that older age shall apply as the applicable minimum age. In the event that we discover a minor is using the platform, the account will be terminated immediately.
8. RETENTION OF PERSONAL INFORMATION
8.1. Your Personal Information will not be retained by CODIQUE any longer than it is necessary for the purposes for which the Personal Information is processed and/or in accordance with legal, regulatory, contractual or statutory obligations as applicable.
8.2. At the expiry of such periods, your Personal Information will be deleted or archived in compliance with applicable laws.
9. CONTROLLING YOUR PERSONAL INFORMATION
9.1. You have the right to invoke your rights, which are available to data principals or data subjects (as per applicable laws and regulations), in relation to your Personal Information, which is being processed by CODIQUE.
9.2.
CODIQUE provides you the ability to keep your Personal Information
accurate and up-to-date. If at any time you would like to a) rectify,
update or correct your Personal Information; b) obtain confirmation on
whether or not your Personal Information is processed by it; c) access
your Personal Information or exercise your right to data portability;
or d) exercise your right to restrict the continuing disclosure of
your Personal Information to any third party by CODIQUE in certain
circumstances, you are requested to contact us provided below. We will
require you to provide a valid proof of your identity in order to
ensure that your rights are respected.
9.3.
For the exercise of certain rights, you may be required to approach
the relevant authority / designated officer as per the provisions of
the applicable data protection laws/ CODIQUE may, in accordance with
the provisions of applicable data protection laws, charge a fee for
fulfilling your request, in particular in case of excessive or
manifestly unfounded requests. Further, you acknowledge that the
above-mentioned rights are not absolute and are subject to limitations
as per the applicable data protection laws.
9.4. At any time, if you wish to delete your account on HEPLO, you may do so by using the settings available in your account.
10. CONFIDENTIALITY AND SECURITY
10.1. The security and confidentiality of your Personal Information is important to us, and CODIQUE has invested significant resources to protect the safekeeping and confidentiality of your personal data. When using external service providers acting as processors, we require that they adhere to the same standards as CODIQUE does. Regardless of where your Personal Information is transferred or stored, we take all steps reasonably necessary to ensure that your personal data is kept secure.
10.2. We seek to ensure compliance with the requirements of the Information Technology Act, 2000, and Rules made thereunder and amended from time to time, to ensure the protection and preservation of your privacy. We have physical, electronic, and procedural safeguards that comply with the laws prevalent in India to protect your Personal Information. By accepting the terms of this Privacy Policy, you agree that the standards and practices being implemented by us are reasonable and sufficient for the protection of your Personal Information.
11. CHANGES TO THIS PRIVACY POLICY
11.1. CODIQUE reserves the right to update, change or modify this Privacy Policy at any time. The Privacy Policy shall come into effect from the date of publication of such update, change or modification.
12. DISCLAIMER
12.1. CODIQUE does not store any account-related information or any credit/debit card details. CODIQUE shall not be liable for any loss or damage sustained by Users as a result of any disclosure (inadvertent or otherwise) of any information concerning the User's account, credit cards or debit cards in the course of any online transactions or payments made for any products and/or services offered through the Platform.
12.2. In case any Personal Information is shared by you with CODIQUE, which is not requested by CODIQUE during registration, (whether mandatorily or optionally), CODIQUE will not be liable for any information security breach or disclosure in relation to such information.
